Terms and Conditions

1. INTRODUCTION
These terms apply to products ordered via the Internet, over the phone or in person at fauxPlay.co.uk.

Seller
1.1 The Seller is fauxPlay Ltd. Registered in England and Wales at Companies House No. 12792779. Registered Office 24 Park Avenue, Ashbourne, Derbyshire, DE6 1GA.

2. ORDER PROCESS
2.1 Our display of products on our website is an invitation and not an offer to sell those products to you.
2.2 An offer is made when you place the order for your products – either online, by telephone or in person. However, we will not have made a contract with you unless and until we accept your offer (see point 2.4 below).
2.3 We take payment from your card, when we process your order and have checked your card details. Products are subject to availability. If we are unable to supply the products, we will inform you of this as soon as possible. A full refund will be given if you have already paid for the products.
2.4 Once fauxPlay Ltd accepts your order, a contract to purchase the goods from fauxPlay Ltd takes effect between you and fauxPlay Ltd.

3. PAYMENT
3.1 We do not keep customers debit/credit card details at fauxPlay Ltd. Our secure payment is provided by Stripe for online sales and SumUp for face to face or telephone sales.

4. DELIVERY
4.1 Orders may generally require a signature to acknowledge delivery. The signature of the person accepting delivery at the delivery address will be proof that delivery has been received by you or the person, to whom the order is addressed. If no one is available to accept the delivery you will receive a card to advise that a delivery has been attempted. and that the product(s) have [either been left with a neighbour or returned to the Royal Mail sorting office. It is receiver’s responsibility to rearrange delivery.
4.2 We shall have no liability to you in respect of any delay or failure to deliver a product due to circumstances beyond our reasonable control, including (without limitation) delay or failure caused by adverse weather, strikes or transport problems.

4.3 We shall aim to despatch all in-stock items within 3 working days of receiving your order. All made-to order items we aim to despatch within 15 working days of acceptance of your order. Priority creation and delivery is available if you need it. We’d be happy to talk through the options, including any additional costs, if this service is required.

5. RETURNS
5.1 Notwithstanding your statutory rights, we live and breathe making beautiful products people will be blown away by. So if you’re not happy in ANY way with an item we have sent to you, call us or message us as soon as possible and we’ll do what we can to rectify any issues.

That said, we are offering a truly bespoke service for many of our products, so do bear in mind items will be made with your exacting specifications in mind. And we cannot accept any responsibility for specification errors on your part.

But should such a scenario arise, let’s talk about it. We’d hate for you to feel unhappy.

5.2 If a product is faulty or not as specified please inform fauxPlay within 7 days of delivery by emailing enquiries@fauxplay.co.uk or calling 01335 348200.

5.3 Any returns are to be made at the expense of the buyer.

6. GENERAL
6.1 All measurements are approximate.
6.2 The reproduction of colours is as accurate as the photographic and production process will reasonably allow. Colours can appear slightly different from computer screen to screen. Pictures are only a guideline to colour. Free samples of the faux fur are available, so please do contact us to request a sample prior to order. Please note that colours can vary slightly from roll to roll of faux fur.

6.3 All risk in the products we supply to you, in particular the risk of any loss or damage, shall pass to you on delivery of the products to the address you specify in your order. Ownership of the products shall not pass to you until we have received payment in full in respect of such products.
6.4 We shall not be liable for any indirect losses you may suffer, including any loss of profit, income or anticipated savings as a result of our failure to comply with these terms or our negligence.
6.5 These terms, constitute the entire terms on which we will provide products to you and cancel and supersedes all prior arrangements and representations, whether verbal or written.
6.6 We may amend these terms from time to time at our discretion without notice to you. Any amendments will be posted on this website and will supersede any terms and conditions previously published by us.
6.7 No delay or failure by ourselves in exercising or enforcing any of our rights or remedies under these terms shall operate as a waiver of those rights.
6.8 If any one or more of the provisions of these terms should be held by any court to be unenforceable, such provision shall be validly restated to as nearly as possible approximate the intent of the clause and, if such clause cannot be restated for any reason, shall be severable from these terms and deleted.
6.9 You may not assign or sub-contract any of your rights or obligations under these terms to any person without our prior written consent. No third party shall be entitled to enforce any of these terms whether by virtue of the Contracts (Rights of Third Parties) Act 1999 or otherwise.
6.10 All matters concerning and incidental to any offer or agreement for the purchase and sale of products from our website shall be in English and construed and governed according to English law and the English courts shall have exclusive jurisdiction in all such matters.

Please bear in mind we hand-make bespoke products to your exact specification. We aim to dispatch everything we’ve lovingly created within a few days of us giving it its final checks, and we can send items first-class if requested.

Everything will be packaged with care and postage will be tracked once it’s left us to insure against any hiccups beyond our control.

Priority creation and delivery is available if you need it. We’d be happy to talk through the options, including any additional costs, if this service is required. That’s all part of our unique, truly personal service.

Having said that, we will always strive to get our products out to you as quickly as possible, and we will give you clear indications of how long your item might take to reach you.
